ENDLESS DAZE CHARTERS

RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY BEFORE SIGNING

This is a legally binding agreement. By signing below, you acknowledge that you understand and accept the risks involved and waive certain legal rights, including the right to sue.

1. ACTIVITIES COVERED

I understand that I am voluntarily participating in water‑based activities provided by Endless Daze Charters, which may include but are not limited to:

  • Scuba diving

  • Freediving

  • Snorkeling

  • Boat diving

  • Shore diving

  • Training or instructional dives

  • Use of scuba, freediving, or snorkeling equipment

(collectively referred to as the “Activities”).

2. ASSUMPTION OF RISK

I understand that the Activities involve inherent and significant risks, including but not limited to:

  • Drowning or near‑drowning

  • Decompression sickness

  • Air embolism

  • Equipment malfunction or misuse

  • Ocean conditions such as currents, waves, and visibility

  • Marine life interaction or injury

  • Slips, trips, falls, or boat‑related accidents

  • Panic, exhaustion, or physical over‑exertion

I understand that these risks may result in serious injury, permanent disability, or death, even when proper instructions and safety procedures are followed.

I freely and voluntarily assume all risks, both known and unknown, associated with my participation.

3. MEDICAL FITNESS

I certify that:

  • I am physically and mentally fit to participate in the Activities

  • I have disclosed all medical conditions that could affect my safety

  • I am not under the influence of alcohol or drugs

  • I understand it is my responsibility to stop participation if I feel unwell or unsafe

4. RELEASE OF LIABILITY

In consideration of being allowed to participate in the Activities, I hereby release, waive, discharge, and covenant not to sue:

Endless Daze Charters, including its owners, captains, crew, employees, instructors, divemasters, guides, contractors, agents, and volunteers

from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, loss, damage, or death that may occur to me, whether caused by negligence or otherwise, while participating in the Activities.

5. INDEMNIFICATION

I agree to indemnify and hold harmless the released parties from any claims, lawsuits, damages, losses, costs, or attorney’s fees arising out of my participation in the Activities.

6. GOVERNING LAW & VENUE

This Agreement shall be governed by the laws of the State of California, and any legal action shall be brought exclusively in Los Angeles County, California.
